THS Web Hosting (www.thehostserver.com) is a web hosting and domain name registration service provided by CitecAsia, a trading name registed for business in Australia.

Throughout this document and all other policy documents published by us, the terms "member", "you" or "your", refers to you, our customer. The terms "us", :our", "we", "THS Web Hosting", "THS" or "CitecAsia" refers to us, the providor of web hosting, domain registration and related services promoted by and managed through our web site "ThehostServer.com"
 
We strive to provide best practice services to all our customers. This includes not hiding essential anything from you. These guidelines are in simple English and are designed to protect you, other customers and us.

Our Terms of Service (TOS), Privacy Policy and Refund Policy provide important information about our policies and practices. It is your responsability to ensure you read and understand all of our terms and conditions of service.

THS Web Hosting reserves the right to cancel, suspend, or otherwise restrict access to any account at any time with or without notice.

Payment Policies:

1. Prepayment is required before any web hosting or domain registration service is provided, including renewal of any service or product.
2. All payment-due notices (invoice and billing reminders) are sent to you by electronic mail (email). It is your responsability to keep your contact email address up to date at all times. Apart from being an ICANN requirement for domain name registration, it is also important for us to be able to contact you with important notices as well service and accounting reminders and billing information.
3. Our services include the opportunity to order web hosting services and arrange payment for periods of one month (1), three months (3), six months (6) or one year (1). Domain name registration is paid annually unless you extend registration for additional years up to a maximun of ten years (10).  You can extend a registration period at any time so long as the maximum period is no more than 10 years.
4. Some other services (such as additional resources) are billed annualy. All product descriptions include billing period information.
5. Payment will be due on or before the anniversary day of the billing period selected when ordering one of our products or services. Recurring payments as well as annual billing will continue until you cancel the service or account.

Our Responsability

1. We will always acknowledge your order on receipt, and always complete the order as soon as confirmations of payment is made by the payment gateway.
2. We try very hard to include all the information you need to become a member of THS Web Hosting.
   
3. Please note, that it may take from 12 - 48 hours for your payment to be confirmed and your order to be satisfied. Once you have placed an order, you will receive payment confirmation direct from the  Payment Gateway. We also receive confirmation of payment from the Payment Gateway and once confirmation has been received, we will then complete your order. This limits the risk of fraud and we do apologise if unavoidable delays caused by these security processes cause any problems.

Exchange Rates

Exchange rate fluctuations for international payments are constant and unavoidable. Refunds are processed in U.S. dollars and will reflect the exchange rate in effect on the date of the refund. All refunds are subject to this fluctuation and THS Web Hosting is not responsible for any change in exchange rates between time of payment and time of refund.

Late Fees
Web hosting information

1. We grant a grace period of 7 days to allow you time to arrange a forgotten payment. This recognises that we do sometimes forget important responsibilities or some outside event  occurred to prevent you arranging to pay for your web hosting and related services by the anniversary billing day.
2. Failure to remit payment for any service after the 8th day has passed of the anniversary billing date will result in termination of all services.
   
3. It is possible to reconnect you until (10) days has passed but a $60(US) reconnect fee will be incurred for failure to remit payment for services after access has been disconnected.
   
4. All Customer data remaining after ten (10) days of non-payment will be destroyed for security and privacy reasons, unless otherwise required by law.

Late Fees
Domain Registration information

A payment grace period is granted by ICANN for domain name renewals.

However, non payment before or on the anniversary billing day will mean your domain name being locked by ICANN until payment is made.

Continued non-payment incurrs the risk of having your domain name locked by ICANN for upto 3 months and you (the registrant) being a charged a fee of $75US to have the domain unlocked. (The unlocking fee is charged by ICANN and the amount may vary according to ICANN policies. Failure to pay the unlocking fee and the domain name renewal fee will result in the domain name being freed into the wild.

Refund Policy

Our refund policy is explained on our Refund Policy Document which can be viewed by selecting Refund Policy from the web ste menu or clicking here.

THS Web Hosting reserves the right to change, modify or replace our products and services, and  product and service prices at any time.

Site Suspension:

1. THS Web Hosting may, at its sole discretion, suspend any account and any access related to the account. For example, your account may be suspended for violations of our privacy and terms of servive, late payment, or server abuse.
2. By placing an order, you electronically acknowledged and confirm acceptance of all THS Web Hosting policies.
3. In the event of your hosting plan being suspended or deactivated, then THS Web Hosting has no obligation to provide you with a copy of your site content, or to restore your server access to enable you to obtain a copy of your site content.
4. Your account may be suspended without prior notice in the event that your payment becomes overdue. Your website(s) will be temporarily unavailable. Access to you account access and website availability will only become accessible after an overdue payment and reconnection fee has been cleared. 

Account Cancellation:

1. You may cancel your account or a prepaid service at any time via a support ticket or by emailing the site administrators.
2. This does not apply to any excluded services or products described in our Refund Policy.
3. To cancel your account please advise us at least 5 days before the next Invoice is due to be issued. Payment reminders and recurring  billing invoices are issued automatically periodically before the aniversary of the next payment. If your account has a balance due at the time of cancellation, this balance must be paid in full. Cancellation does not absolve you of any outstanding financial obligations.
4. It is your responsibilityto ensure that all data and e-mail is downloaded prior to the cancellation of the hosting services, as once the account is cancelled all data is automatically erased. Email especially cannot be retrieved once deleted whether the account is reopened after renewing for an additional term.

SPAM Policy:

1. THS Web Hosting is committed to a zero-tolerance, anti-Spamming policy. Under this policy, we prohibit Spam, any unsolicited commercial email and any legal or illegal recurring bulk email from being sent over the THS Web Hosting network by customers or any other users of the THS Web Hosting network (including customers' customers); AND/OR over ANY network— if the message sent advertises or mentions a site hosted on any THS Web Hosting servers unless otherwise permitted by specific arrangements.
2. We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any customer disregarding this policy. Sending unsolicited commercial email (a.k.a. "spam"), cross-posting messages to a large number of usenet groups, posting obscene or threatening messages while using or referring to a THS Web Hosting email address or web site URL is prohibited. The use of THS Web Hosting servers as a mail drop for responses to activities described above is also prohibited. Accounts canceled due to spam will be billed a "clean up" fee of $500.
   
   

If you have any complaints or comments regarding Spam on our network, please send us your comments by email to the THS Web Hosting administrators.

 
Server maintenance:

1. Our Data Center(s) perform regular server maintenace, as well as from time to time, performing server operating system upgrades  and / or replacement of old server hardware with new. We reserve the right to suspend access to such servers during the required time to upgrade or exchange server hardware. In this event, members of THS Web Hosting are are sent an e-mail at least 24 hours before the due date and time for server maintenance.
2. Any unpredictable event such as hardware failure or power outage (although power generators are in place), may force our Data Center to temporarily shutdown to perform maintenance in order to restore the services as quickly as possible. In this event, THS members will probably not be advised prior to the shutdown period. 

Back Ups

1. Full backups are made regulary by the Data Centre. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is your responsibility to maintain local copies of your web content and any other information.
2. Every hosting plan provides FTP access and this can be used to restore previous backup files that you make, however, you should not rely on server backups that may have or may not have the latest version of your website, data or files.
   
3. If loss of data occurs due to an error whether caused by THS Web Hosting or the data centre, we will attempt at no charge to you.to recover your data.
4. We do not guarantee in any way, express or implied, that we can recover any data.
   
5. If data loss occurs due to your negligence in securing your account or web site data, or by an action caused by you regardless of whether the action was made by mistake, THS Web Hosting will attempt to recover the data from the most recent archive, however charges may apply. 

Modification:

THS Web Hosting reserves the right to add, delete, or modify any provision of its terms of service at any time without notice.

Your Responsabilities

1. It is your responsibility to ensure that the contact details for your account are always up to date Your email address is the primary means of contacting you with important notices and is also the primary means of proof of ownership of a domain name registration.
2. It is your responsability to ensure the security of your account, web site content, databases and that use of the THS Web Hosting service is not breached by any malicious person or person(s). We will do our best to provide effective advise on best practices when asked.
3. It is your responasbility to ensure payments for all services are made before or on the day of order, or in the case or recurring billing, on or before the anniversary day of the first order.

Modifications to our Terms of Service (TOS)

If our Terms and Conditions of Service are modified, you will be notified by email sent to the primary email address non record. We request that you ensure that emails from admin [at] thehostserver [dot] com are not blacklisted or treated as spam by you or your email service providor. In other words, put our email address in your white list.

Acceptance of agreement:

By registering as a member of this web site and by ordering and making a payment for any service or product provided, you acknowledge that you have read this agreement and that you  have accepted our Terms of Service and any other conditions stated our ploicy documents. THS Web Hosting reserves the right to amend our Terms of Service at any time and without notice
